NOTICE – Pure Propane is an independent sales team working under brokers who are connected with nationwide suppliers. We are not a supplier. We do not own, store, or deliver propane. Title passes directly from supplier to you. See UCC §2-312.
 

1. OUR SERVICE

We connect you with local propane suppliers. We:

• Take your order by phone

• Collect full payment upfront via ACH

• Pass order to supplier for delivery

We do not own, store, or deliver propane. Any Fulfillment/Delivery Issues are NOT under the Liability of Pure Propane.
 

1.1 Broker Relationship – Pure Propane, LLC (“Broker”) maintains zero physical inventory. Risk of loss transfers to you at the supplier’s fill valve.
 

2. ORDER & PAYMENT

• 100 gallon minimum

• You provide: address, tank size, access instructions

• We quote: Total $ amount (includes supplier cost + delivery + Pure Propane coordination fee)

• Full payment due immediately via ACH/e-check

• SMS sent with e-signature authorization document

• You click “Accept” → binding contract
   

2.1 E-Signature – Your click-to-accept via SMS is a legally binding electronic signature under E-SIGN and UETA.
 

2.2 ACH Authorization (NACHA §3.12) – “I authorize Pure Propane, LLC to initiate a one-time ACH debit from the account I provided for the full order amount. This authorization is ‘in writing’ and remains in force until revoked in writing delivered to broker at least 3 business days prior to debit.”
 

2.3 NO HIDDEN FEES – Total price disclosed on call + SMS. Includes:

• Supplier cost (fuel + delivery)

• Pure Propane coordination fee No markups. No surprises.
   

3. DELIVERY

• Scheduled delivery after payment clears — proceeds with original date details.

• Delivery suspended or cancelled if ACH/e-check fails.

• You ensure: clear 24/7 access, code-compliant tank (NFPA 58 §6.8)

• We are not liable for delays, errors, or damage
   

3.1 Estimated Window – 3–7 business days from payment confirmation (excluding weekends, holidays, Force Majeure).
 

3.2 Force Majeure – Weather, road closures, DOT hours-of-service, supplier outages, government orders. Broker’s sole duty: notify you and offer account credit per Refund Policy.
 

4. YOUR RESPONSIBILITIES

• Give accurate info

• Ensure tank access

• Authorize valid ACH/e-check

Breach = order cancel + $150 processing fee + any bank fees.
 

5. LIMITATION OF LIABILITY

Our max liability = amount you paid. No liability for supplier actions or indirect/consequential damages (including property damage, leaks, explosions, or business loss).
 

5.1 AS-IS Propane – Delivered “as-is” by supplier. Broker disclaims all warranties. Supplier warrants compliance with NFPA 58 and 49 CFR Part 192.
 

6. INDEMNIFICATION

You indemnify Pure Propane from any claim arising from your premises, tank condition, or post-delivery propane use.
 

7. DISPUTE RESOLUTION

• Contact us first within 7 days: support@purepropane.online | (888) 424-0169

• 30-day informal negotiation via certified mail

• Binding arbitration under AAA Commercial Rules in Monterey County, CA

• NO CLASS ACTIONS

• You pay our costs + attorney fees if we prevail

Unauthorized payment returns = contested with proof + $150 fee.
 

8. GOVERNING LAW

California law, without regard to conflicts. Federal Arbitration Act governs arbitration.
 

9. FRAUD & FAULTY PAYMENTS

False info, bad checks, or disputes =

• $150 fee

• Collections

• Civil lawsuit (you pay our costs) Enforceable under CA Penal Code § 496.
